The legal requirement
Under Regulation 25 of SI 2005/42, applicants for premises licences, club premises certificates, and provisional statements must advertise in both a local newspaper (Reg 25(b)) and by displaying a blue notice on the premises (Reg 25(a)).
The newspaper notice must appear within 10 working days of the day after the application is given to the licensing authority. Separately, a 28-day representation period begins the day after the application is submitted (SI 2005/42 Reg 25(a) made under Licensing Act 2003 s.17(5)(c)) — the newspaper notice does not trigger or start that period.
If the notice is not published within the 10-working-day window — or appears in the wrong newspaper — the licensing authority may reject the application or require re-advertising. Getting the timing right matters.
Timing: two separate requirements
The 28-day representation period starts the day after the application is given to the licensing authority (SI 2005/42 Reg 25(a)). It runs regardless of when the newspaper notice appears.
Separately, the newspaper notice must be published within 10 working days of that same starting point (Regulation 25(b)). It does not trigger or restart the 28-day period.
