The legal requirement
The Highways Act 1980 requires newspaper advertisement for three categories of order: s.116 (stopping up of unnecessary highways via the Magistrates Court — procedural requirements in Schedule 12), s.118 (extinguishment of public rights of way — Schedule 6 Part I para 1(3)(a) requires publication in a local newspaper circulating in the area), and s.119 (diversion of footpaths and bridleways — also subject to Schedule 6).
Where a stopping-up is needed to enable development, s.247 of the Town and Country Planning Act 1990 provides a separate authorisation route through the Secretary of State, rather than the Magistrates Court under HA 1980 s.116.
For s.116 stopping-up orders (Sch 12 Part I para 3), publication must occur at least 28 days before the magistrates' court application date — this is a pre-application lead-time requirement, not a post-publication objection window.
For ss.118 and 119 orders (Sch 6 para 1(1)(c)), the notice must specify a representation period of at least 28 days from the date of first publication; the authority may set a longer period. Failure to advertise correctly can render an order vulnerable to legal challenge.
